Is CBD legal, and how?

Is CBD legal in the UK?

Long story short, yes – CBD is legal in the UK. On its own, the cannabinoid is not considered a controlled substance under the Misuse of Drugs Act.

However, under the Misuse of Drugs Regulations (2001), CBD products such as CBD oil must have a THC content (THC being the psychoactive and illegal compound in cannabis) of less than 1mg per retail unit like a bottle. It is a common misconception that the limit is 0.2% however this threshold is to do with the difference between hemp and cannabis plants, not to do with the extracts and finished retail products The CBD must also be extracted from EU approved industrial-grade hemp strains to ensure this.

As Cannabis is considered a Class B drug, CBD producers must possess a licence to grow hemp or cannabis as well as permission from the UK Home Office. Any CBD products that are sold must be done so by either a licensed medical distributor or as a nutritional supplement.

UK CBD Regulation

The UK Food Standard Agency (FSA) has announced a deadline of March 21st 2021 for all businesses operating in the CBD industry to submit a novel food authorisation application. After this date, only CBD products with a valid application will be able to trade legally.

This will ensure all CBD products sold on the market are provided with the correct information regarding the safety and contents of the products. This authorisation is necessary for increasing consumer trust in the UK CBD market after an independent research study in 2019 by the Centre of Medical Cannabis (CMC) revealed that less than eleven of the thirty CBD Oils actually contained less than half of the CBD content advertised. Some oil products didn’t contain any CBD at all, and some contained large amounts of THC, making them illegal.

Often less honest CBD suppliers will claim their products has a certain CBD concentration percentage, but in reality, it has less when checked against their lab analysis. For example, they too may say their product has 500mg of CBD, but it may only be 200mg CBD and 300mg CBDa. It, therefore, will not be half as strong as our CBD oil dose-for-dose.
